- Eligibility: In order to be eligible for Fox 18’s The X Factor Audition Pass Contest (hereafter referred to as “Event”) you must be a legal U.S. resident, 12 years of age or older as of January 1st, 2012, who resides in the KLJB-TV viewing area, which consists of the following Illinois counties: Bureau, Carroll, Hancock, Henderson, Henry, Jo Daviess, Knox, LaSalle, Lee, McDonough, Mercer, Ogle, Rock Island, Stark, Warren and Whiteside; and the following Iowa counties: Cedar, Clinton, Des Moines, Henry, Jackson, Lee, Louisa, Muscatine and Scott, who is eligible to work in the United States. You are ineligible if you fail any of the above requirements. You are ineligible if you already have any type of talent representation (for example, a talent agent or manager), a music recording contract, a merchandising agreement, or any other contractual arrangement that would prohibit you from entering into a management contract, recording contract and merchandising contract. You are ineligible if you have won in any KLJB-TV or KGCW-TV contests in the last ninety (90) days. Employees, shareholders, officers, directors, agents, representatives, and their immediate family members and those living in the same household of KLJB-TV, KGCW-TV, Pepsi, advertising agencies, corporate sponsors or any person or entity connected with the production, administration or judging of the auditions, or any of their respective parent companies, affiliates, subsidiaries, agents or representatives are not eligible. If you do not meet these requirements, your entry will be discarded.
- How to Register for the Event: To enter, viewers must post a video of their performance on www.kljb.com. Viewers can also mail or drop off a video recording of their performance at KLJB-TV Fox 18 at the address listed at the end of these rules. Submissions will be accepted starting April 11th and all submissions must be received by KLJB-TV no later than 11:59pm on Wednesday, May 2nd, 2012.
- What We Will Be Looking For: Entries will be judged on several criteria, including vocal ability and stage presence. Backup music is allowed and encouraged, but not required. Music should not contain lyrics (use a Karaoke version, if possible), but if vocal tracks are audible, they can not override the entry’s own voice or else it will be disqualified. Instruments are not allowed.
- Selection of Winner: A panel of judges selected by KLJB-TV will view every entry received and select the winner on Thursday, May 3rd, 2012. Judges’ decision is final.
- Prize: One winner will be selected. The winners will receive front-of-the-line passes to the national The X Factor auditions in Providence, RI on May 10th, 2012. If any winner-select is unable to travel during that time (May 9th through May 11th), that winner will be disqualified and another winner will be selected.
- Paperwork: You will be required to fill out, sign and agree to all of the terms and conditions of our required forms. Failure to completely fill in any and all paperwork required will result in your automatic disqualification.
- Disqualifications: We reserve the right to disqualify and/or exclude, in our sole and absolute discretion, any individual from any part of the process for any reason or for no reason at all, including without limitation, violation of any portion of these rules, or tampering with the entry process or the audition process. We also reserve the right to change the rules and procedures at any time. Being chosen to audition and/or compete at any level in the process does NOT ensure that you will be selected to continue to the next stage, either at the local or national level.
- General Conditions. By participating, entrants agree to be bound by these rules and the decisions of the producers and the panel of judges, which shall be final and binding. Entrants also agree to indemnify KLJB-TV, Pepsi, FOX Broadcasting Company, News Corporation, FOX Interactive Media, FremantleMedia North America, Inc., Syco Limited, their parent, subsidiary, affiliated and related entities, and the officers, directors, employees, licensees and assignees of each with the Event and to hold the Producer and such other persons harmless from any and all liability, claim, action, damage, expense and loss of any kind caused by or arising out of any statement, action or failure to act by you during or in connection with your participation in the Event. Your entry in the contest, and any friends, family members, or anyone else who appears in your video, constitutes your and their consent and agreement to the recording and use of your and their performance, appearance, name, voice, singing voice, likeness and any musical or sound effects produced by you and/or them for use in connection with any television program, motion picture or the internet for all purposes (including advertising, marketing, promotion, merchandising and the exploitation of any and all ancillary and subsidiary rights), as the same may be edited, in all media, throughout the universe, in perpetuity for no compensation, unless otherwise required by law. If you and/or your friends, family members, or anyone else accompanying you to the audition, do not wish to be photographed, or do not agree with these terms, PLEASE DO NOT ENTER. You and/or their failure to do so will be conclusively deemed to be a waiver of any and all claims for invasion of privacy, defamation, etc. All federal, state and local laws apply. KLJB-TV, KGCW-TV, Pepsi, and the advertising agencies or any person or entity connected with the production, administration or judging of the auditions, or any of their respective parent companies, affiliates, subsidiaries, agents or representatives are not responsible for and shall not be liable for: (i) any failure of transportation, bad directions, or inability for any reason to appear at an audition site or audition or appear before the judging panels; (ii) any injuries, losses or damages of any kind caused by traveling to or from the audition venues, being present at the audition venues, participating in the auditioning process or being selected to or disqualified from continuing in the auditioning process and/or the show; or (iii) any printing, typographical or technological errors in any materials associated with the auditioning process.
